A freelance musician showed a video of an obscene act to a 10-year-old girl and molested her while her two younger brothers watched.
On Friday, Harry Shawn Fernandez, 42, was found guilty of stripping and molesting the girl at a staircase landing in Woodlands. For this, and a separate charge of molesting a 41-year-old woman, he was sentenced to 26 months in jail and four strokes of the cane.
The court heard that on Aug 12 last year, Fernandez followed the girl and her eight- and six-year-old brothers into a lift on their way home from school. As they were walking, he called out to them from behind.
He showed the girl a video on a mobile phone, and when the siblings tried to leave, he dragged them to a staircase landing. He removed the girl's clothes and re-enacted what was shown in the video on the girl while her brothers watched.
When he was done, he told her to put on her clothes and asked all three to follow him to the first floor. The girl refused. Fernandez let them go but said: 'Do not tell anybody. If not, I'll kill you.'
The three ran home in tears and told their grandmother and an aunt about the incident. The police subsequently identified and arrested Fernandez on Sept 29.
In submissions to the court, Deputy Public Prosecutor Toh Puay San stressed that the victim was very young and that Fernandez had violated her modesty. The film had also corrupted her young mind.
He was sentenced to 18 months and four strokes of the cane for outraging the girl's modesty, three months' jail for showing her an obscene film, and four months' jail for threatening to kill her.
On Jan 21, Fernandez molested a woman at a Bencoolen Street hotel. He was sentenced to four months' jail. The prosecution said the offence was committed while he was out on bail for the earlier case. Three of his four sentences will run consecutively. Three other charges were taken into account.
