Man filmed rape of teen

A 21-year-old Milltown man is accused of raping an 18-year-old female acquaintance and taking pictures of himself having sex with her after the woman passed out in his apartment, police said.

Police charged Dan Tam Leof of the first block of Abbey Lane at the Abbey Walk Apartments, with second-degree rape and invasion of privacy.

The incident occurred June 29 at Le’s apartment, New Castle County police spokesman Senior Cpl. Trinidad Navarro said.

According to court records, the 18-year-old victim has known Le since high school.

The victim told police that she “passed out after taking a prescribed muscle relaxant” and fell asleep in Le’s bed fully clothed, police said in court records.

When she awoke, she was partially clothed and there was evidence that she had been sexually assaulted, police said. Le was asleep in the bed next to her, police said.

The victim then scrambled to find her cell phone to call a friend to pick her up, and not finding it grabbed Le’s cell phone next to the bed to make the call.
When the victim touched the screen, about 10 photographs depicting her unclothed appeared on the phone, according to the court records.

She said she called a friend to pick her up and drive her to state police Troop 6 at Prices Corner to report the sexual assault.

State police then turned the investigation over to county police because the incident occurred in their jurisdiction.

An investigation revealed that the suspect had taken video and photos of the assault, which had been deleted, but retrieved by investigators during a forensic exam of his cell phone, according to court records.

Police said the photographs show Le engaging in sexual intercourse with the victim, who is unresponsive. Le faces a July 20 court hearing.
